PRIVACY POLICY

In accordance with the provisions of Regulation (EU) 2016/679, of the European Parliament and of the Council, of 27 April 2016, MOTORS I VENTILADORS SL, hereinafter the RESPONSIBL, with Tax Identification Number (NIF) B58967183, informs the User that their personal data will be processed in order to provide the services requested and to send them information about our company that may be of interest to them.

Submission and registration of personal data

The transmission of personal data is obligatory in order to contact and receive information about the services provided by the RESPONSIBLE. Likewise, failure to provide the personal data requested or not accepting this data protection policy means the impossibility of subscribing, registering or receiving information about these services.

When personal data are obtained from the data subject through electronic communications networks or within the framework of the provision of an information society service, as well as in those other cases expressly established by law or when authorised by the Spanish Data Protection Agency, the data controller may comply with the duty of information established in article 13 of Regulation (EU) 2016/679 by providing the data subject with at least the following basic information:

• The identity of the data controller and of his or her representative, where applicable.
• The purpose of the processing.
• The manner in which the data subject may exercise the rights set out in Articles 15 to 22 of Regulation (EU) 2016/679.

However, controllers and processors or, where applicable, their representatives shall maintain the register of processing activities referred to in Article 30 of Regulation (EU) 2016/679, unless the company or organisation employs fewer than 250 persons, except where the processing carried out by it is likely to result in a risk to the rights and freedoms of data subjects, is not occasional, or involves special categories of personal data referred to in Article 9(1) or personal data relating to criminal convictions and offences referred to in Article 10 of Regulation (EU) 2016/679.

Finally, Article 5(1)(f) of Regulation (EU) 2016/679 determines the need to establish appropriate security safeguards against unauthorised or unlawful processing, against loss of personal data, accidental destruction or damage. This implies the establishment of technical and organisational measures aimed at ensuring the integrity and confidentiality of personal data and the possibility (Article 5(2)) to demonstrate that these measures have been put into practice (proactive accountability).

Accuracy and veracity of the data provided.

The User who sends the information to the RESPONSIBLE is solely responsible for the veracity and correctness of the data included, exonerating the RESPONSIBLE from any liability in this regard.

Users guarantee and are responsible, in any case, for the accuracy, validity and authenticity of the personal data provided, and undertake to keep them duly updated. The User agrees to provide complete and correct information in the registration or subscription form.

The RESPONSIBLE is not responsible for the veracity of the information that is not of its own elaboration and of which another source is indicated, and therefore does not assume any responsibility for hypothetical damages that may arise from the use of this information. The RESPONSIBLE is exonerated from liability for any damage or harm that the User may suffer as a result of errors, defects or omissions in the information provided by the RESPONSIBLE, provided that it comes from sources outside the RESPONSIBLE.

Transfer of data to third parties

The RESPONSIBLE will not transfer personal data to third parties. However, in the event of transfer to a third party, prior information will be provided by requesting the express consent of the data subject in accordance with Article 4.11 of Regulation (EU) 2016/679.

Retention of data

In any case, the time of conservation will be the essential time, and must be kept as a minimum:

• 4 years: Law on Infractions and Penalties in the Social Order (obligations regarding affiliation, registrations, cancellations, contributions, payment of salaries...); Arts. 66 et seq. General Tax Law (accounting books...)
• 5 years: Art. 1964 Civil Code (personal actions without special time limit).
• 6 years: Art. 30 Code of Commerce (accounting books, invoices...)
• 10 years: Art. 25 Law on Prevention of Money Laundering and Financing of Terrorism.

Exercise of Rights of Access, Rectification, Deletion, Limitation, Portability and Objection

Acceptance and Consent

The User declares to have been informed of the conditions on the protection of personal data, accepting and consenting to the processing of the same by the RESPONSIBLE, in the manner and for the purposes indicated in this Personal Data Protection Policy.

Changes to this privacy policy.

The RESPONSIBLE reserves the right to modify this policy to adapt it to new legislation or jurisprudence, as well as to industry practices. In such cases, the RESPONSIBLE will announce on this page the changes introduced reasonably in advance of their implementation.

*reCAPTCHA

We use the reCAPTCHA service of Google Inc. (Google, hereinafter referred to as Google) to protect the data of our users submitted via the forms on the pages. This service makes it possible to differentiate between data submitted by individuals from automated messages and involves the transmission of the IP address and other data required by Google for the use of the reCAPTCHA service. For this purpose, the data will be transmitted to Google so that it can be used. The IP address will be encrypted by Google in member states of the European Union as well as in partner states of the European Economic Area. Only in exceptional cases will IP addresses be transmitted to a Google server in the USA for encryption. On behalf of the operator of this website, Google will use this information for the purpose of evaluate the use of the service by users. In compliance with Regulation (EU) 2016/679, of 27 April 2016 (RGPD) and Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSI-CE), MOTORS I VENTILADORS SL, hereinafter the RESPONSIBLE, hereby informs users that it has created a profile on the social networks LINKEDIN, INSTAGRAM, TWITTER, FACEBOOK, YOUTUBE, VIMEO, PINTEREST and FLICKR with the main purpose of advertising its products and services.

The user has a profile on the same Social Network and has decided to join the page created by the RESPONSIBLE, thus showing interest in the information that is advertised on the Network. By joining our page, you give us your consent to the processing of personal data published in your profile.

The user can access the privacy policies of the Social Network at any time, as well as configure their profile to guarantee their privacy.

The RESPONSIBLE has access to and processes public information about the user, in particular the user's contact name. This data is only used within the Social Network itself. They are not incorporated into any file.

In relation to the rights of access, rectification, deletion, limitation, portability and opposition, which you have and which can be exercised against the RESPONSIBLE, in accordance with Regulation (EU) 2016/679, you must take into account the following nuances:

*Access: This will be defined by the functionality of the Social Network and the capacity to access information from users' profiles.

*Rectification: This can only be satisfied in relation to information that is under the control of the RESPONSIBLE, for example, deleting comments posted on the page itself. Normally, this right must be exercised before the Social Network.

*Cancellation and/or Opposition: As in the previous case, this can only be satisfied in relation to information that is under the control of the RESPONSIBLE, for example, to stop being linked to the profile.

*Portability: the possibility of transferring data from one controller to another is foreseen, whereby the data subject shall have the right to have his or her personal data transferred directly where technically possible.

*Limitation: This is a precautionary measure that reduces the processing of personal data to storage.

The cases in which the data subject shall have the right to obtain from the data controller the limitation of the processing of the data are set out in the regulation and are as follows:

-Where the data subject contests the accuracy of the personal data, for a period of time allowing the controller to verify the accuracy of the personal data.

-Where the processing is unlawful and the data subject objects to the erasure of the personal data and requests instead the restriction of their use.

-Where the controller no longer needs the personal data for the purposes of the processing, but the data subject needs them for the purposes of formulation, the right or defending claims.

-When the data subject has objected to the processing by exercising his or her right to object, while it is being verified whether the legitimate grounds of the controller outweigh those of the data subject.

The RESPONSIBLE will carry out the following actions:

• Access to the public information of the profile.
• Publication in the user's profile of all information already published on the RESPONSIBLE's page.
• Sending personal and individual messages through the Social Network channels.
• Updates of the status of the page that will be published on the user's profile.

The users can always control their connections, delete content that is no longer of interest and restrict who you share their connections with by accessing into the privacy settings.

Publications

The user, once linked to the RESPONSIBLE's page, may publish on the latter comments, links, images or photographs or any other type of multimedia content supported by the Social Network. The user, in all cases, must be the owner of these, hold the copyright and intellectual property rights or have the consent of the third parties concerned. Any publication on the page, whether text, graphics, photographs, videos, etc., that violate or are likely to violate morals, ethics, good taste or decorum, and/or that infringe, breach or violate intellectual or industrial property rights, the right to image or the law, is expressly prohibited. In these cases, the RESPONSIBLE reserves the right to immediately remove the content, and may request the permanent blocking of the user.

The RESPONSIBLE will not be held responsible for the content that a user has freely published.

The user must bear in mind that his publications will be known by other users, so he himself is primarily responsible for his privacy.

The images that may be published on the page will not be stored in any file by the RESPONSIBLE, but they will remain in the Social Network.

Contests and Promotions

The RESPONSIBLE reserves the right to carry out contests and promotions, in which the user linked to its page may participate. The terms and conditions of each of these, when the Social Network platform is used for this purpose, will be published on the same. Always complying with the LSSI-CE and any other applicable regulations.

The Social Network does not sponsor, endorse or administer, in any way, any of our promotions, nor is it associated with any of them.

Advertising

The RESPONSIBLE will use the Social Network to advertise its products and services, in any case, if it decides to treat your contact details to carry out direct actions of commercial prospecting, it will always be in compliance with the legal requirements of Regulation (EU) 2016/679 and the LSSI-CE.

Recommending the RESPONSIBLE´s website to other users so that they can also enjoy promotions or be informed of its activity will not be considered advertising.
